LATAM Cancelled and Delayed Flight Compensation

LATAM Flight Delay Compensation

Even though it isn't a European airline, you could get 600€ in compensation for your delayed flight with LATAM. When your international flight with LATAM is delayed, there is a chance that you’re eligible for a compensation. But because LATAM is not a European airline, this applies only to their flights departing from Europe, not to flights leaving from Latin America and arriving in Europe.

Why can you hope for a compensation in these cases? Because the EU Regulation 261/2004 (EC261 in short) protects your passenger rights. The airline (probably) hasn’t told you about those - few airlines do, especially non-EU airlines. The flight compensation amount is calculated based on the distance of the journey: since flights with LATAM departing from Europe are usually over 3,500km long, passengers victims of flight delays with the air carrier are entitled to 600€ in compensation.

Keep in mind, however, that to be eligible, the airline must be responsible for the cause of the delay. For example, if your flight arrived late due to air traffic control restrictions, adverse weather conditions, or any other extraordinary circumstances, you won't be entitled to a monetary compensation. If, on the other hand, the airline could have prevented the delay, they must enforce your right to compensation. This happens in the case of a technical problem, for instance.

So next time your flight from Europe with LATAM is delayed, take the time to verify whether you’re eligible: you may get up to 600€ from the airline. Just fill out our Compensation Calculator for Flight Delays and you will know in less than 3 minutes what you can hope for!

      LATAM Cancelled Flight Compensation

Just like delays, the cancellation of your flight may get you between 250 and 600€. Once again, EC261 protects you when this happens to your flight from Europe with LATAM.

Keep in mind that the EU law is slightly more complicated than with delays. The exact amount varies according to more factors, including the length of the delay for example. Also, your eligibility depends on when (or if) the airline warned you about the cancellation. If the airline notified you at least 14 days in advance that your flight was cancelled (or rescheduled), then you are not entitled to compensation.

You should also remember that when your flight is cancelled, you are entitled to more than a compensation: the airline must also offer you a choice between:

      - a rerouting to your destination as soon as possible

      - the refund of your ticket

      - another flight to your destination at the date of your choice (provided that seats are available)

The easiest option for you is to fill out our Compensation Calculator. In less than 3 minutes, you'll know if you're entitled to a compensation for cancelled flight, and how much the airline owes you.

      LATAM and Compensation Claim Processing

While LATAM’s flight performance is above average their claim processing performance is below average. They are rather slow to solve claims compared to the rest of the industry.
